The first refusal of the courts to amnesty is made public: Paramacay case

The lawyer Luis Armando Betancourt reported that the Judge Luis Ovalles denied the dismissal of the case corresponding to the «Paramacay Case»which in his opinion flagrantly ignores what is established in the Amnesty Law for Democratic Coexistence.

Betancourt made the complaint in the afternoon of February 27. In X, he asserted that the decision to maintain the judicial process against Juan Carlos Caguaripano, Omar Escalante, Jose Rengifo and other citizens constitutes a direct violation of the principle of legality.

He noted that the accused face charges of treason and rebellion.

Through his social networks, the jurist described the judicial system as a “tool of political persecution” by ignoring an existing law.

Betancourt demanded immediate compliance with the regulations and respect for the procedural guarantees of the detainees.

“The amnesty is not discretionary, it is the law of the Republic,” stated Betancourt. He emphasized emphasizing that legal regulations must be applied above any subjective criteria of the court.

He Paramacay Case goes back to August 6, 2017when a group of approximately 20 people, led by the former captain of the Bolivarian National Guard (GNB), Juan Carlos Caguaripano Scottassaulted the Fort Paramacay in Valencia, Carabobo state.

The objective of the operation, called “Operation David”was to steal high-powered weapons to start a resistance movement against the government of Nicolás Maduro. After a confrontation that left two dead and several injured, Caguaripano and the captain Yuaris Rengifo They managed to escape with the arsenal, being captured days later in Caracas.

Those involved were accused by military courts of crimes such as treason, rebellion, theft of effects belonging to the Armed Forces and attack on the sentry.

Currently, figures such as Caguaripano, Omar Escalante and Jose Rengifo They remain in custody, despite the complaints of their lawyers about compliance with the requirements to benefit from the Amnesty Law.
