The Attorney General’s Office (AGU) and the Ministry of Women sent this Wednesday (25) to the National Council of Justice (CNJ) a request to investigate the conduct of the judge of the Court of Justice of Minas Gerais who acquitted a man accused of rape of a vulnerable girl against a 12-year-old teenager and the girl’s mother, who had allegedly connived at the crime.
In the demonstration, the AGU said that the decision of the 9th Criminal Chamber, which was based on the vote of judge Magid Nauef Láuar, violates the Constitution and the Adolescent Child Statute (ECA).
“The interpretation of the supposed formation of a family nucleus is impossible given the entire legal system that protects children and adolescents. It is not a relationship of affection, of family, but rather a relationship of sexual exploitation”, argued the body.
Retreat
Earlier, given the repercussion of the case, the judge issued an individual decision and reinstated the first instance decision who sentenced the man and the teenager’s mother. The magistrate also ordered the arrest of the accused.
