Santo Domingo.– The Executive Branch ordered the extradition of the Dominican Thelmo Issa Ortega Luna to the Kingdom of Spain, in compliance with the Constitution and the laws of the Republic.
The measure is contained in Decree no. 123-26. Ortega Luna is accused of drug trafficking with serious danger to public health foreseen and punishable in article 368 of the Spanish Penal Code.
The extradition request was presented by the Embassy of the Kingdom of Spain through Note Verbal no. 75, of April 1, 2025, following an international requirement issued by the Court of Instruction no. 1 of Valladolid, within the framework of preliminary proceedings no. 3802/2015.
The decree specifies that said surrender for extradition is provided under the condition that the Dominican national Thelmo Isaa Ortega Luna will under no circumstances be imposed the death penalty or the life sentence of imprisonment, as a consequence of the infraction for which his extradition is ordered.
