Santo Domingo. – The lawyers of the former deputy financial director of the Attorney General’s Office, Alfredo Solano Augusto, rejected the statements of the Public Ministry, which through a press release attributed to the defense the presentation of incidents for dilatory purposes in the judicial process that also involves the former attorney Jean Alain Rodríguez.
The jurists Manuel Sierra and Ybo René Sánchez Díaz clarified that, during the hearing held on February 18, the judge of the Second Collegiate Court of the National District, Claribel Nivar Arias, did not issue reproaches against the defense lawyers, but instead urged the parties to synthesize their statements with the purpose of expediting the knowledge of the case, given its complexity and volume.
“The Public Prosecutor’s Office is lying when denouncing alleged delaying tactics. This is the presentation of defense media that the court itself authorized through resolution 00034/25 in favor of the accused,” the defendants expressed.
As they explained, the incidents raised are part of the procedural mechanisms approved by the court in that resolution, which is why they maintain that their actions have been carried out within the guarantees established by law.
Debate on the duration of the process
The defense recalled that the investigation began on August 20, 2020 and that the case has gone through various judicial stages since then. They pointed out that the length of the file, which exceeds 12 thousand pages, has influenced the duration of the trial.
The Public Ministry, for its part, has indicated in public communications that some incidents presented by the defenses have contributed to delays in the development of the process.
The lawyers reiterated that there has been no dilatory conduct on the part of the defense and affirmed that their procedural behavior has been consistent with the rights of the accused.
Likewise, they insisted that the alleged reproaches by the court did not occur and that the judge only requested greater synthesis in the presentations to facilitate the progress of the trial.
“Therefore, the alleged reproaches for the lawyers to organize their incidents, and many of the alleged delays or delays at the hands of the lawyers, are not true. This is information distributed through a note from the MP, in a malicious manner with the purpose of hide their failures in the Jean Alain Rodríguez case”said Sierra and Sánchez.
Procedural background
The jurists recalled that, during the preliminary hearing held in January 2023 before the Third Investigative Court of the National District, the court rejected similar statements about alleged delaying tactics attributed to the defense.
The process continues its course before the Second Collegiate Court of the National District, where the accusations of the Public Ministry and the arguments of the defenses are heard. So far, no final decision has been issued on the merits of the case.
