The Executive will toughen its actions so that the Port of Chancayowned by the Chinese state company Cosco Shipping, is supervised by the Supervisory Body for Investment in Public Transport Infrastructure (Ositran).
The president of the Council of Ministers, Ernesto Álvarez, stated that the government will make use of the procedural resources that the law empowers it to appeal the ruling of the Judiciary (PJ), which limits Ositran’s supervisory powers over the Port of Chancay, because due to its nature of investment it does not justify the participation of the regulator.
Through a statement, Álvarez indicated that the opinions of various professionals are being taken in order to obtain a more informed position.
“We are concerned that, being an extremely important port for Peru and for all trade in the Pacific, there may be some aspect of the activity or a part, whether of the sea or the territory itself, of the port facilities, that cannot be subject to supervision by the regulatory body,” he said.
The head of the PCM asserted that, if a favorable response is not obtained from the PJ, the presentation of an appeal to the Constitutional Court will be analyzed.
“The Constitutional Court is not only limited to civil or maritime law clauses, it is the main defender of the Constitution and, therefore, of national sovereignty. In addition, a very important issue must be taken into account. There is no civil contract that can be above the Constitution,” he asserted.
Unacceptable
Likewise, Álvarez described it as unacceptable that Ositran cannot supervise the port of Chancay.
However, he highlighted Peru’s diplomatic doctrine that is based on multilateralism, which is why he said he greatly appreciated the commercial relationship with China, and at the same time, the importance of the strategic alliance with the United States.
“China is our main trading partner at this moment. As for the United States, it is a strategic and hemispheric relationship because it embodies the values and principles on which Peruvian society was built, which are pluralism, democracy, freedom, private and individual action, as the main source of creation and wealth,” he said.
