Violations at Grok continue, say MPF, ANPD and Senacon

The Federal Public Ministry (MPF), the National Data Protection Agency (ANPD) and the National Consumer Secretariat (Senacon) evaluated the responses presented by X platform and concluded that the measures reported by the company were insufficient in relation to its artificial intelligence (AI) tool, Grok, which has been improperly used to generate and circulate images of people in a context of sexualization, in an unauthorized manner.Violations at Grok continue, say MPF, ANPD and Senacon

Last month, the three entities issued a series recommendations to platform X. Among these recommendations was the adoption of technical and operational procedures to identify, review and remove content of this type that is still available on X, when generated by Grok based on commands made by users.

In a new statement, released this Wednesday (11), the three bodies determined that X immediately implements effective measures to prevent the production, through Grok, of sexualized or eroticized content of children and adolescents and adults who have not expressed consent.

The institutions also determined to provide information on the measures already adopted by the company to resolve the problems identified in the recommendation. The MPF, in turn, ordered X to provide monthly reports on its performance on the topic and highlighted that the company was not transparent in its response.

The ANPD, the MPF and Senacon work in a coordinated manner to investigate the facts related to the misuse of the Grok artificial intelligence tool. Each institution has an open administrative procedure against the platform, according to its areas of competence.

In the case of ANPD, the preventive measure requires that the resources that prevent the misuse of the AI ​​tool must cover all versions, plans and modalities of Grok.

Within the scope of the MPF, it was required to send monthly reports, starting this month of February, with details on how X is acting to iprevent and repress the production of deepfakes involving children and adolescents and adults without their prior authorizationindicating the number of harmful posts that were taken down and the number of accounts involved in these practices that were suspended, in each reported period, by the platform’s controllers.

If not complied with, the social media company could be fined daily. Those involved may also be liable for the crime of disobedience and the company may suffer more severe investigative measures, in addition to being the target of legal action, the MPF said.

In an administrative precautionary measure, Senacon demanded proof of measures already adopted to contain the identified risks and remedy the problems highlighted in the joint recommendation.

It was also required to detailed metric report submissioncontaining verifiable quantitative data on the identification, moderation, removal and unavailability of sexualized content related to the operation of Grok, including the number of content identified and removed, average response times, technical criteria used and possible adoption of additional corrective measures, such as suspension of accounts or restriction of functionalities.

The report attempts to contact the Platform X consultancy in Brazil, to obtain a position on this new joint demonstration by the MPF, ANPD and Senacon.
