The Federal Supreme Court (STF) received this Wednesday (11) a request from associations representing judges, prosecutors, public defenders and members of audit courts to maintain payment for the penduricalhos that were suspended by order of minister Flávio Dino (photo).
The request was made by 11 associations, which also asked to participate in the process. The entities include the Association of Brazilian Magistrates (AMB), the National Association of Labor Justice Magistrates (Anamatra), the Association of Federal Judges of Brazil (Ajufe) and the National Association of Public Prosecutors (ANPR).
Last week, Dino granted an injunction to determine that compensation funds that have no legal basis must be suspended within 60 days in the Three Powers. Penduricalhos are financial benefits granted to public servants that do not meet the constitutional salary ceiling, which is R$46,300.
In the understanding of the entities, all payments made by the Judiciary and the Public Ministry are provided for by law or in rules of the National Council of Justice (CNJ) and the National Council of the Public Ministry (CNMP).
“It is now necessary to accept the present embargoes for clarification so that, verifying that there has been no payment to the judiciary without prior authorization from the CNJ, the courts will no longer be required to review the normative acts that implement the payments provided for by law”, state the associations.
Earlier, the São Paulo Court of Justice (TJSP) also defended in the STF the maintenance of penduricalhos.
The Supreme Court plenary scheduled the final judgment of Minister Flávio Dino’s decision to suspend payment of the penduricalhos for February 25th.
