The appeal was filed after, last January, the JEE of Huánuco declared the applications of Lozano and Criollo inadmissible. According to the electoral body, the party did not reserve number 1 on the list of Senate candidates for that region and that, since the former PNP In the primary elections, it was not up to the party to opt for direct appointment.

In its resolution, the JEE indicates that the party violated what is stated in article 30 of the Election Regulations, “which requires respecting the result of the primary elections.”

For this reason, the electoral body adds that, because Lozano was not correctly registered, it was not possible to present the complete list of candidates to the Senate for Huánuco. In addition, the JEE said that another person can no longer be appointed because the deadline expired on December 23.

This reason caused the JEE to declare the Senate candidates as “insurmountable” and the list of candidates for the Senate for Huánuco was classified as inadmissible.

Now the Nation responds

Now Nación presented the appeal and assured that the decision of the JEE Huánuco violates the right to political participation, due procedure and the principle of legality of the Senate candidates.

Likewise, the document indicates, it was criticized that the JEE had admitted or transferred an “opposition procedure” of a natural person unrelated to the procedure for presenting and admitting the list of candidates. In that case, reference was made to citizen Elías Espinoza, who complained about having been removed as a candidate despite having been elected in the internal elections, but who was later suspended by the party itself.

Along the same lines, the party questioned that the JEE only ruled on the candidacies on January 21 and that it did so through an “official letter”, “which has flagrantly violated effective procedural protection and due administrative procedure.”

Furthermore, they defended Lozano’s candidacy by indicating that, since there were no successors to take Espinoza’s place, the colonel was placed in retirement.

“Therefore, the decision was adopted due to the need to maintain the list of candidates for the Senate in a complete manner,” the appeal reads.
