Demonstrations and social pressures 'lower' controversial Court projects

Before, they lowered the project that resolves the unconstitutionality action 73/2019 promoted by the Human Rights Commission of Mexico City against article 60 of the Constitutional Law on Human Rights and its Guarantees of Mexico City, regarding evictions.

The Human Rights Commission claimed that this article violates the principle of progressivity and non-regression in matters of human rights, since the rights to decent and adequate housing were eliminated, and maintained that the forced evictions provided for in the norm are “incompatible” with international treaties that do not prohibit the use of force or violence during the eviction.

Meanwhile, the project of Minister María Estela Ríos plans to establish that article 60 of said law does provide guarantees and appropriate means of legal protection against evictions, since it is mentioned that these can only be carried out by court order.

Given the proposal, members of the CdMx Anti-gentrification Front and Popular Congress demonstrated one day before the discussion, since they maintained that the draft ruling proposed the validity of “forced evictions.” The demonstration caused the Court to lower the draft sentence and until now there is no date for its discussion.

Another case is the draft ruling by Minister Irving Espinosa Betanzo, in which he resolves the constitutionality of a reform on abortion in Aguascalientes. This is because in 2024 the state Penal Code reduced the period for abortion from 12 to six weeks, and establishes that anyone who does so after that period will be punished with prison.

In project A172/2024, it proposes to declare the invalidity of this state reform and mentions that women and people with the capacity to conceive should be allowed to interrupt their pregnancy at least within the first 12 weeks of gestation, which is before the development of sensory and cognitive faculties.

Days after this project was discussed, the Archdiocese published in its editorial From faith He accused that Minister Espinosa Betanzo’s project sought the total decriminalization of abortion.

“The draft sentence is influenced by a very clear ideology, that of the throwaway culture, to eliminate without any problem the human being who becomes an obstacle. They do not think about the woman or the baby, only about “getting rid of a problem quickly and pragmatically,” said the Archdiocese.

Meanwhile, organizations such as Catholics for the Right to Decide mentioned that this “postponement” kept the women of Aguascalientes in legal and medical uncertainty, who cannot decide since the reform to reduce the deadline for abortion in 2024 was endorsed.

Three other projects that were generating controversy were removed from the list on January 19. Two were proposals from Minister Yasmín Esquivel Mossa that correspond to protections under review 424/2025 and 446/2025 and which proposes to protect real estate companies, since the Attorney General’s Office (FGR) secured properties without a court order.

This case arose from properties in the Santa Fe area of ​​Mexico City, intervened in 2024 without a mandate and under the argument of the Public Ministry that they are property of the Nation.

The minister rapporteur points out in the project that the FGR acted irregularly by not requesting a court order as established in article 252 of the National Code of Criminal Procedures.
