The new Central Highway Daniel Alcides Carrión, the Santa Rosa Expressway and the Santa Rosa Bridge are once again in the news and not precisely because the works that will be carried out under the Government to Government (G2G) modality with France have already been carried out.
And uncertainty was recently generated by a statement from the G2G Project Management Office (PMO Vías) in which it reported that the Ministry of Transportation and Communications (MTC) had terminated the contract intended to provide technical assistance for the execution of the aforementioned initiatives. Immediately, the first question that arose is whether the European country would continue with the ongoing process.
In this regard, the executive director of Provías Nacional, Claudia Dávila, explained to Perú21TV that the agreement that had been concluded is with EGIS and that it refers specifically to technical assistance, not to the execution of the works.
“EGIS has a key subcontractor which is the PMO Vías, which is the commercial name that has been used, but strictly speaking, the contract signed is with EGIS,” he clarified.
As detailed, the reason why this decision was made is due to the application of clause 13.1 of said agreement, after the commission of acts of corruption by a public official abroad was verified.
“The EGIS company has a conciliation agreement with the Paris Prosecutor’s Office (France) where it has been determined that they have committed the crime of corruption of officials abroad. This is fully documented and proven. The company has recognized it, it has never denied the crime, it only says that it did not commit it in Peru, but clause 13.1 allows it to have that key to resolve the contracts,” he added.
It should be noted that in a letter sent to PMO Vías, Provías also establishes that it has been found that various companies in the EGIS group have been sanctioned and disqualified by multilateral financing organizations for “fraudulent and corrupt” practices.
Meanwhile, Claudia Dávila reported that through the Foreign Ministry, they will ask the European country to present another company to provide technical assistance in the three works just as the French company did. Meanwhile, the official assured that the schedule and execution of these projects will not be affected by the resolution of the aforementioned contract.
“The contractual part in the works and execution is between Provías and the contractor. All responsibility for the execution of the project, for the payment of valuations, for the execution of the program, for the application of penalties, is in the hands of Provías. EGIS is a technical companion,” he stated.
For example, he explained that in the case of the Santa Rosa Bridge, the contractor is the Puente Chalaco Consortium (made up of the companies Sacyr and Aecon), which would demonstrate that there would be no impact on the terminated contract.
