The most falsified document in public procurement

One of the documents that most falsifies suppliers of the Dominican State in the procurement of goods and services is the guarantee of faithful performance that they must present when participating in a tender, as revealed this Thursday by the general director of Public Procurement, Carlos Pimentel.

The official maintained that the State cannot continue receiving guarantees of faithful performance, which sometimes have no support and leave the contracting institutions without the possibility of being able to execute them because the company that issues it does not have solvency sometimes.

“In some cases (companies) have issued guarantees that are above their solvency and we also have to put that on the table. We cannot have a (public) administration that awards, signs a contract and delivers 20 percent and then does not receive goods, services, or anything. The official, who spoke during a meeting organized by the Industry Association of the Dominican Republic (AIRD), reported that the new Law 47-25 of Public Procurement, which came into effect at the end of last January, raises compliance standards.

“We are going to remove the culture of non-compliance and that requires that the contracting entities execute the guarantees and we are going to advance the quality of those guarantees,” he stated.

He said that there can be no apathy or fear on the part of officials when terminating a contract for breachexplaining that to break an agreement for that reason, a due process and is voided unilaterally.

“You cannot continue in an administration where the breach contractual does not execute a guarantee of performance and where a contract is not terminated for breach and, much less, informs the governing body when there are breach so that the due process and establish the corresponding sanctions,” he stated.

New law

During his presentation, the head of Public Procurement highlighted the benefits of the new normamong them the reinforcement of national production through an increase in the participation of micro, small and medium enterprises (MSMEs) in tenders, going from 20% in the previous law to 30% in the current one.

Likewise, he highlighted the increase from 5% to 10% in the participation of MSMEs led by women.

The president of the AIRD, Julio Virgilio Brachestated that the regulations constitute a milestone in the modernization process of the Dominican State, by redefining the relationship between the public sector and its suppliers and strengthening the public procurement as an instrument of development, efficiency and value creation for society.
