The president of the Superior Electoral Court (TSE), minister Cármen Lúcia, stated this Monday (2) that she will present a proposal to discipline the actions of electoral judges during the October presidential elections.
During the opening session of the Judiciary Year 2026, a ceremony that marks the return to work after the recess, the minister stated that the rules of conduct will be presented during a meeting with the presidents of the regional electoral courts (TREs), scheduled for February 10.
According to Cármen Lúcia, the rules represent parameters for the behavior of magistrates for elections.
According to the proposal, electoral judges must publish the agenda of hearings with parties and lawyers.
Judges will not be able to make statements about the processes being processed in the Electoral Court and must also be prohibited from participating in events with candidates or their allies.
Magistrates will also not be able to publish their political choices on social media.
Judges will be prevented from receiving gifts or favors that cast doubt on their impartiality.
Ethics
According to the president, voters expect ethics in the actions of judges and employees of the Electoral Court.
“From the electoral judiciary, the electorate not only expects ethical, efficient performance and strictly in accordance with current legislation, but everyone expects that the body of judges and justice employees
Electoral representatives act honestly, regardless of pressure or influence to guarantee the holding of elections in which there are no doubts about the fairness of the election”, he stated.
Earlier, Cármen Lúcia, who is also a minister of the Federal Supreme Court (STF), rapporteur of the Court’s Code of Ethics was chosen.
The announcement about the creation of a Code of Ethics for members of the Supreme Court comes after Minister Dias Toffoli was criticized for his conduct of investigations involving fraud at Banco Master.
