The 3rd Criminal Chamber of the Court of Justice of Rio de Janeiro (TJRJ) decided to acquit Marcus Vinícius Medeiros, Flamengo’s youth football monitor, in the process that investigates responsibility for the fire that hit Ninho do Urubu, in 2019. The decision of the second instance upheld the sentence handed down by the 37th Criminal Court.
The fire in one of the dormitories of the Flamengo training center left ten dead and three injured. Against Marcus Vinícius there was an accusation that he had walked away from his job and, therefore, had left the young people helpless.
The Justice considered that Marcus Vinícius was a worker and only obeyed superior orders. Rapporteur Suimei Meira Cavalieri highlighted that he had no possibility of imagining the risks in the early hours of the accident.
In addition, the Justice accepted the defense’s claim that Marcus Vinícius did not contribute to the accident and even put himself at risk by saving three victims.
The other defendants will continue to answer for the crime of arson qualified by the results of death and serious injury in another case, after the dismemberment on November 10 of last year.
