Last Monday, January 26, Judiciary read the sentence against the State Attorney General (PGE), Maria Caruajulcafor the crimes of omission and refusal of functional acts. The reading of the ruling was carried out by the judge Carolina Huamani Reyeswho ordered that Caruajulca pay a civil reparation of S/1,500 and serve a 30-day fine.
Caruajulca’s case is due to her management as attorney of the Municipality of Comasin which he refused to hand over the list of complaints filed during his mandate. This decision violated the principles of public transparency.

For this reason, in 2020, the president of the Lima Norte Supervision and Anti-Corruption Leaders Association, Dylan López, denounced the acts.
Years later, Judge Huamaní Reyes concluded that it was proven that Caruajulca gave orders to reject requests for information. The ruling mentioned that the constant refusal to provide public documents violated rights and constituted an abuse of authority.
It is important to highlight that the main function of the State Attorney General’s Office is to represent and defend the interests of the Peruvian State, as well as to denounce high officials such as congressmen, ministers, among others.

María Caruajulca will not go to prison and appealed the decision
Although the Public Ministry requested a custodial sentence of 8 months, the Judiciary considered that, because Caruajulca does not have a criminal record, only rules of conduct will be issued that the magistrate will review from time to time.
On the other hand, during the hearing, the public official announced that she would file an appeal to have the ruling against her annulled.
