An audit report of the Special Electoral Jury (JEE) of Lima Centro 1 concluded that the presidential candidate of the Patriotic Party of Peru, Herbert Caller Gutierrezwould have presented false information in his Affidavit of Resume (DJHV) for not having registered a final judgment against him for execution of guarantees.
According to Report No. 000004-2026-ABC-JEELIMACENTRO1-EG2026/JNE, of January 26, prepared by the inspector Antonia Bernales Chávez, a citizen filed a complaint in which he maintains that Caller had allegedly omitted said information at the time of his registration, for which he requested that the sanction of exclusion be imposed against the presidential candidate.
In this context, Bernales searched for the ruling in “Consultation of Judicial Files” of the Judiciary on File No. 02541-2020-0-3204-JR-CI-01.

After that consultation, the auditor attached screenshots showing that Caller was sued for execution of guarantees before the Civil Court of Lima Este in December 2021. In addition, she specified that the status of the file is in a state of “execution.”
Likewise, this report detailed that, in May 2022, the Judiciary declared the claim against Caller founded and ordered the payment of S/84,000 plus legal interest for late payment in favor of the plaintiff.
Along the same lines, resolution No. 4 of June 28 of the same year was registered, in which the court assured that the resolution has final status, having not been challenged by the parties.
“(…) The candidate stated that he has no information to declare; however, from the Consultation of Judicial File No. 02541-2020-0-3204-JR-CI-01, carried out on 01/25/2026, processed before the 1st Civil Court, on execution of guarantees, it is noted that, through Final Orders 053-2022, dated 05/13/2022, the lawsuit filed against the candidate was declared founded. Therefore, there would be false information declared by the candidate,” the document reads.

Political party should provide defenses
As part of the right to defense, the inspection report recommended requesting information from the legal representative of the Patriotic Party of Peru, in order to clarify what was stated in the inspection report of the JEE Lima Center 1.
Possible sanctions
The inspection report recalled the Law of Political Organizations (LOP), which refers to the alleged existence of false information on resumes.
In this sense, the procedures that are followed were detailed. First, we begin by correcting the candidate’s DJHV; A fine of up to 10 UIT is then imposed, depending on the severity of the infraction. Finally, the proceedings are sent to the Public Ministry so that it acts in accordance with its powers.
