The Subcommittee on Constitutional Accusations of the Congress decided to dismiss constitutional complaint number 596 filed against the former president Dina Boluarte Zegarra.
This appeal, which was originally raised by the then prosecutor of the Nation Delia Espinoza, sought to prosecute the former president for alleged illicit enrichment and omission of declaration in a public document for the Rolex case.
During the session, chaired by Lady Camones, the subcommittee did not evaluate the accusations against the former president for the use of luxury watches and high-value jewelry, but rather relied solely on the Congress Regulations. According to the technical report, the events reported on May 16, 2025 had already been the subject of a final report that was resolved on April 11 of that same year, which concluded in the file.
The current regulation prohibits filing complaints about the same fact within the same legislative period. For this reason, the technical team pointed out that the inadmissibility corresponds to compliance with the norm in the face of results that were already provided by the Permanent Commission.
In May 2025, the Permanent Commission of Congress ratified the file of the investigation against Boluarte with 14 votes in favor and 8 against. On that occasion, the then president was spared from giving an account of the expensive gifts received from the governor of Ayacucho, Wilfredo Oscorima, better known as the Wayki of the former head of state.
Despite the current file, the moderator of the session clarified that this resolution does not definitively close the possibility of future investigations. In accordance with Article 89 of the Congressional Regulations, a new complaint could be filed later, provided that new evidence is presented, and the deadlines and requirements established by law are respected.
