The Third National Criminal Court of Appeals left to vote the request of the legal defense of former president Martín Vizcarra, so that the execution of the 14-year sentence against him for alleged irregularities in works Lomas de Ilo and Hospital de Moquegua be suspended, until the execution of the sentence against him is ultimately confirmed, a sentence for which he has been serving in prison since last November 26.
Vizcarra’s request comes in the middle of the electoral campaign in which his brother Mario is participating as a presidential candidate for Peru Primero, and in which the former president, now imprisoned, is campaign manager.
The decision that could free the vacant former president is in the hands of judges Víctor Joe Manuel Enríquez Sumerinde —president of this court—, María Eugenia Guillén Ledesma and Yeny Sandra Magallanes Rodríguez.
Erwin Siccha, Vizcarra’s lawyer, supported the request before the court to revoke the conviction, arguing among other reasons the state of health of the former head of state, pointing out that he worsened after his admission to the Barbadillo prison and that he urgently needs an operation on one of his kidneys.
The defense of the now imprisoned former president also asked the magistrates to assess the conduct shown by his client throughout the process against him and that he always appeared at the hearings and complied with the restrictive measures imposed on him.
Siccha requested that Vizcarra’s judicial situation be changed by ordering him, provisionally, freedom with a simple appearance and restriction measures, while this appeal seeking his early release from prison is resolved.
