Deputies and senators today (17) overturned a veto by the President of the Republic regarding the validity of public tenders approved before the covid-19 pandemic. With the overthrow of the veto, the text of the project will be valid, which suspends the validity periods of these contests until December 2021.
The idea of the project vetoed by the Planalto, and which will only now be promulgated, is not to harm those approved in the contests. This is because a 2020 law forbade the increase in expenditure by the Public Power with personnel until the end of 2021 and prevented the appointment of new servers. The parliamentarians considered the issue fair, because it guarantees the rights of those approved in public tenders to take office.

The National Congress also overturned Bolsonaro’s veto on provisions of the Emergency Resumption Program for the Events Sector (Perse). The original text of the program goes to promulgation. Sanctioned in May 2021, the article provided for the installment of debts of companies in the event sector with the Federal Tax Authorities, in addition to other actions to compensate for the loss of revenue due to the covid-19 pandemic. Among the vetoed sections was the forecast of a zero rate of PIS/Pasep, Cofins and Social Contribution on Net Income (CSLL) for 60 months and the extension, until December 31, 2021, of the Emergency Credit Access Program for sector companies.

Deputies and senators overturned the presidential veto on the device that will allow states and municipalities to use another account, other than the specific one for moving resources from the Fund for the Maintenance and Development of Basic Education and the Valorization of Education Professionals (Fundeb) to make payments of salaries to teachers with funds from the fund. The text allows the payment of teachers in financial institutions other than Banco do Brasil and Caixa Econômica Federal.

Another device vetoed by Bolsonaro and overturned by congressmen was the part of the Over-the-Counter Sales Program (ProVB), of the National Supply Company (Conab). The measure guarantees corn from the public stock to small animal breeders for lower values.
The vetoed device will allow family farmers who do not have an active Declaration of Aptitude (DAP-Pronaf) to have access to the cheapest price for corn. These producers must meet criteria such as gross annual income in force under Pronaf or rural property explosion with an area equivalent to up to 10 fiscal modules.
Road transport
Lawmakers also overturned a veto that removes an inspection fee to be paid by long-distance road transport companies. With this, a device approved in Congress takes effect that revokes the value of the inspection fee for the provision of services and infrastructure exploration to be paid by companies that carry out interstate and international passenger transport.

Congress maintained the veto of exemption from the Tax on Industrialized Products (IPI) for the purchase of automotive accessories by taxi drivers and people with disabilities. The stretch was included in the project to extend the IPI exemption on car purchases by this public. The government, however, argued that the accessories were not included in the law that created the exemption.
Another veto maintained concerns adoption. The vetoed project allowed the adoption of children only after all attempts to reintegrate into the biological family had been exhausted. According to the government, these reintegration attempts “can become endless, revictimizing the adopter with each attempt to return to the family of origin”. In addition, such a measure, the government understood, could jeopardize the children’s chances of being permanently adopted.

Today was dedicated solely to the analysis of presidential vetoes in a joint session of deputies and senators. However, before the start of the session, party leaders agreed to withdraw the analysis of 14 vetoes for next week. Among them are excerpts from Provisional Measure 1031/21, which provides for the privatization of Eletrobras; the legal framework for startups; on crimes against the democratic rule of law; and on the certification of charities.
Another presidential veto that had its analysis postponed was the project that authorized the opening of supplementary credit in the amount of R$ 1.7 billion in the Budget in execution.
