The Criminal Chamber of the Supreme Court of Justice declared that the 15-year prison sentence issued against the psychologist Carlos Alberto Ortiz Mora accused of committing sexual abuse of one of his patients remains intact, according to judgment No. 102 drafted by Judge Francia Coello.
At the time, the adolescent victim stated that she had family problems and, seeking professional help, contacted the psychologist Ortiz Mora. This, taking advantage of her state of vulnerability, seduced her for sexual purposes, the sentence refers.
The aforementioned complaint was filed with the Cicpc’s Division of Investigations and Protection for Children, Adolescents, Women and Families. As a result, the psychologist was charged with sexual abuse of an adolescent without penetration, pornographic exhibition of adolescents, carnal act with a particularly vulnerable victim, and illicit possession of a firearm.
The trial began on January 9, 2018 and on December 8, 2020, the 2nd Trial Court with jurisdiction over crimes of Violence against Women in Caracas sentenced Ortiz Mora to serve 15 years in prison for having committed the crime. carnal act with a particularly vulnerable victim.
The aforementioned Court acquitted the psychologist of the rest of the crimes. The conviction was appealed and the Court of Appeals rejected the proposal, confirming the conviction.
Before this situation, Ortiz Mora’s lawyers went to the Criminal Chamber of the TSJ. The magistrates checked the file and detected that the decision by which the psychologist was sentenced was not duly notified to the victims, with which their right to defend themselves was affected.
For this detail, the Criminal Chamber annulled all the decisions made after the issuance of the sentence “which will remain intact.” To correct this situation, the Chamber forwarded the file to the corresponding Court so that it may notify the parties of the conviction against the psychologist.
