Minister Alexandre de Mores, of the Federal Supreme Court (STF), ordered the opening of a new investigation to investigate the alleged leak of tax data from Court ministers through bodies such as the Financial Activities Control Council (Coaf) and the Federal Revenue Service.
The investigation, reported by Moraes himself, was opened without provocation from the Attorney General’s Office (PGR) or the Federal Police (PF), an unusual procedure, although provided for in the Internal Regulations of the Supreme Court.
The existence of the investigation, which is being carried out under secrecy, was revealed by the Poder 360 portal and confirmed by Brazil Agency.
Understand
The investigation comes after the press revealed links between family members of Supreme Court ministers and Banco Master, institution embroiled in a financial fraud scandal and whose investigation is being carried out in the Court itself, under the report of Dias Toffoli.
Among the revelations is that Toffoli’s brothers and cousins sold a stake in a resort in Paraná to a fund linked to Fabiano Zettel, brother-in-law and partner of Daniel Vorcaro, owner of Master.
The two have already been the target of search warrants and temporary arrest issued in the investigation reported by the minister himself.
Still in December, the newspaper The Globe revealed that the law firm managed by Viviane Barci, wife of Alexandre de Moraes, closed a contract worth R$129 million to represent Banco Master according to demand, before the financial fraud scandal came to light.
Moraes suspects that this information was leaked from Coaf or the IRS.
Inquiry
Despite being criticized by the Public Ministry and by jurists and experts, the opening of official investigations by a minister of the Supreme Court is provided for in the Internal Regulations, which in its Article 43 states that: “if there is a violation of criminal law at the headquarters or premises of the Court, the President will open an investigation, if it involves an authority or person subject to his jurisdiction, or will delegate this attribution to another Minister”.
At the moment, Moraes occupies the presidency of the Supreme Court, with the absence of the current president, Edson Fachin, due to the Judiciary recess.
The revelations brought about by the Master case have led Fachin to suggest the creation of a code of conduct for ministers of higher courts, including the Supreme Court..
In his speech to close the year 2025, the minister placed the issue among the court’s priorities for this year.
