A request from Jair Bolsonaro’s defense to “house arrest humanitarian” was what led Federal Supreme Court (STF) minister Alexandre de Moraes to order the transfer of the former president of the Republic to the Papuda Penitentiary Complex.

Moraes’ order that determined the transfer contains statements from Bolsonaro’s children stating that the place where the former president was in the PF did not have “minimum dignity” conditions.

In the order, the minister recalled that the former president was being held in much better conditions than other prisoners convicted of participating in the 2023 coup d’état attempt and highlighted that Bolsonaro will go to an environment with better qualities.
The individual Federal Police cell where the former president was serving his sentence is 12m², with a private bathroom, running and heated water; color television; air conditioning; minibar; PF doctor on duty 24 hours a day; authorization for 24-hour private medical access; authorization to carry out physiotherapy; daily and exclusive sunbathing; visits reserved without the presence of other prisoners, among other benefits.
The minister pointed out that the new unit, in Papuda, has better conditions with a total area of 64.83 m², of which 54.76 m² are covered and 10.07 m² are external. The infrastructure includes environments such as bathroom, kitchen, laundry room, bedroom, living room and outdoor area.
In addition, the accommodation includes a kitchen with the possibility of preparing and storing food, a bathroom with a shower with hot water, a refrigerator, closets, a double bed and a TV.
Five meals a day will be offered (breakfast, lunch, snack, dinner and supper) by the custodian unit. Bolsonaro will also have space at his disposal to sunbathe, with total privacy and free time.
“It should be noted, however, that these absolutely exceptional and privileged conditions do not transform the definitive fulfillment of the sentence of Jair Messias Bolsonaro, convicted by the leadership of the criminal organization in the execution of the very serious crimes committed against the Democratic State of Law and its Institutions, in a hotel stay or in a holiday camp, as erroneously several of the demonstrations previously described seem to demand, when comparing the General Staff Room to a ‘captivity’, when presenting complaints about the ‘size of dependencies’, ‘sunbathing’, ‘air conditioning’, ‘visiting hours’, when distrusting the ‘origin of the food’ provided by the Federal Police, and, when demanding the exchange of the ‘television for a SMART TV’, to even ‘have access to YOUTUBE’, Moraes emphasized.
The location in Papuda also includes the installation of gym equipment, such as a treadmill and bicycle. Place for visits and assistance from lawyers and doctors. According to Moraes, the space for visits is ample, and can take place both indoors and outdoors, “with chairs and a table available in both environments”.
At Papuda, Bolsonaro will have the right to visit his wife Michelle Bolsonaro, his children Carlos Bolsonaro, Flávio Bolsonaro, Jair Renan, Laura Bolsonaro and his stepdaughter Leticia Marianna Firmo da Silva, for three hours, to be shared by the visitors.
“Thus, before analyzing the new request for humanitarian house arrest, an examination must be carried out by a medical board of the Federal Police, to analyze the current situation of Jair Messias Bolsonaro in custody and possible adaptations to continue serving his sentence in the new location”, says the decision.
