Teófilo Fasabi Pizango was sentenced to 10 years in prison after being found guilty of the crime of acts against indecency to the detriment of his niece, a minor under 7 years of age.
The events occurred repeatedly during 2013. However, the judicial process was only able to be carried out in 2015, when the convicted person, aged 60, participated in the trial virtually.
During the oral trial, prosecutor José Carlos Bustamante Martínez managed to prove the criminal responsibility of the accused through various elements of conviction, among them, the victim’s statement made in the Gesell camera, considered key evidence.
According to the complaint, the events occurred in the home of the convicted person, located in the hamlet of Yacusiza, in the town center of Aucayacu, district of José Crespo y Castillo, province of Leoncio Prado, where the minor went to spend the night at the request of a cousin.
The judges of the Permanent Supraprovincial Collegiate Criminal Court of Leoncio Prado assessed the minor’s testimony, describing it as coherent and solid, as well as the psychological expertise that confirmed the serious emotional damage suffered by the victim.
Likewise, the Public Ministry warned during the process of the possible existence of other affected minors, so the referee ordered the sending of copies to the Prosecutor’s Office for the beginning of a new investigation against the convicted person.
Regarding civil reparation, the court ordered the payment of 7,000 soles in favor of the victim, in addition to providing free psychological treatment for the minor and her parents, guaranteeing comprehensive care after the trauma experienced.
