The Supreme Court of the United States left pending this Wednesday the resolution on some of the duty imposed by the president donald trump.
After announcing three rulings on other cases, the Court did not announce the next date on which it will issue its resolutions.
On February 1, 2025, Trump invoked the International Emergency Economic Powers Actl (IEEPA) to impose tariffs on imports from the People’s Republic of China, Canada and Mexico, declaring emergencies related to illicit drugs and illegal immigration.
Then, on April 2, 2025, Trump declared a separate emergency regarding “the lack of reciprocity in our bilateral trade relations, disparate tariff rates and non-tariff barriers, and economic policies of America’s trading partners that suppress domestic wages and consumption, as evidenced by America’s large and persistent annual goods trade deficits.”
As part of the legal process, on September 9, 2025, the Supreme Court decided to hear two cases, VOS Selections, Inc. v. United States and Learning Resources, Inc. v. Trump, in which lower courts ruled that the IEEPA does not give the president the legal authority to impose at least some of these tariffs.
During arguments in the case last November 5, conservative and liberal judges appeared to cast doubt on the legality of the tariffs. Conservative and liberal Supreme Court justices that day questioned Trump’s use of emergency power to impose tariffs on American imports.
Trump has used the IEEPA as the basis for tariff orders related to fentanyl and migration concerns against Mexico, Canada and China, and as a measure to almost every country in the world to reduce the United States trade deficit.
Yes ok no American president has ever used the IEEPA to impose tariffs, political advisers close to Trump have argued that the law’s broad powers could allow him to implement tariffs quickly with less need for investigations or oversight.
Supreme Court Chief Justice John Roberts questioned Trump’s use of the IEEPA to collect tariffs, arguing that this law is almost 50 years old and has never been used for that purpose.
