Moraes keeps prisoner convicted of bombing at Brasília airport

In the decision, given in Petition (Pet) 12445, Moraes explains that there is a real risk that, if released, the defendant could commit new crimes. He recalled that Alan Diego fled Brasília shortly after the failed attack at the airport and was only arrested in June this year, in Mato Grosso, after being sought by the police.

“There is, therefore, strong and serious evidence of the concrete risk of repeating the crime and the application of criminal law, due to escape after committing crimes, considering the beginning of the criminal investigation, after receiving the complaint,” he wrote.

The judge highlighted, in the decision published this Wednesday (31), that there is no new fact that changes the current situation.

“The need to protect public order and criminal investigation stands out, as there is no supervening fact that could eliminate the need to maintain precautionary custody.”

In October, the minister had already denied the release request made by the convicted man’s defense.

Coup attempt

Alan has been in prison since June this year by decision of the minister, after the Attorney General’s Office (PGR) filed a complaint against him and two other people for the crimes of attempted abolition of the Democratic Rule of Law, coup d’état and armed criminal association, in addition to requesting his preventive detention.

Two others involved in the same episode of the truck bomb, on Christmas Eve 2022, are: blogger Wellington Macedo de Souza, sentenced to 6 years in prison for planning the attack and giving Alan a ride on the day it happened; and George Washington de Oliveira Sousa, who admitted to having purchased an arsenal adopted in the attempted attack, such as explosives and ammunition.

According to the records, Alan Diego dos Santos Rodrigues installed the bomb in a tanker truck parked near the federal capital’s airport and confessed to having received the device at the camp in front of the Army Headquarters, in Brasília, where people were defending a coup d’état.

In May 2023, the 10th Federal Court of the Federal District sentenced Alan Diego and two other defendants to five years and four months in closed prison for the crimes of explosion and fire.

The investigation was then forwarded to the STF for analysis of possible crimes against the Democratic Rule of Law.

In December 2025, in a virtual session, the First Panel of the Supreme Court unanimously decided to make Alan Diego a defendant for more serious crimes related to the Democratic Rule of Law, such as attempted coup d’état and armed criminal association. Therefore, accepting the PGR’s complaint.
