Last Friday, Carlos Jaico, presidential candidate of Modern Peru, formulated before the Special Electoral Jury of Lima Oeste 3 (JEE Lima Oeste 3) an objection that aims to declare null the list of candidates for the Senate for the single national district of Fuerza Popular, party of Keiko Fujimori.
“In exercise of the right to petition, I request that the nullity be declared ex officio with respect to the list of candidates presented by the aforementioned political organization,” reads the document to which he had access. Peru21.
As part of the argumentation of his request, Jaico maintained that, according to article 24-B of the Law of Political Organizations, up to 20% of all candidates for Congress can be designated among their members or non-members by the body of the political organization established by the statute.
This same party body is the one that, in turn, defines the location of those appointed, “respecting the principles of internal democracy.”
In the document, Jaico reviews a fragment of Fuerza Popular’s statute. In article 56, it is indicated that it is a power of the party presidency, that is, Keiko Fujimori, to “directly appoint the candidates.” However, the statute does not expressly indicate the limit of candidates that Fujimori can appoint, as is established in the official documents of other parties.
“In the case of the Fuerza Popular political organization, the location on the list of the candidate César Augusto Astudillo Salcedo has been determined by a body that lacks jurisdiction to do so,” says Jaico.
“In effect, the statute of Fuerza Popular, in its article 56, is limited to attributing to the presidency the power to designate candidates, without expressly establishing that said body also has the power to define their locations on the list,” it continues.
Consequently, the document indicates that Astudillo’s appointment “was made incorrectly and solely for the purpose of completing the list.” This situation, he assures, “implies a serious injury to the process of internal democracy.”
“Thus, the incorrect appointment of Astudillo determines that all the other appointees are in the same situation and therefore, the Fuerza Popular list is incomplete and has failed to adequately participate in the primary elections,” he says.
