A total of 152.3 thousand policyholders of the National Social Security Institute (INSS) who won legal actions against the agency will start 2026 with more money in their pockets. The Federal Justice Council (CJF) authorized the release of R$2.3 billion in arrears to retirees, pensioners and other Social Security beneficiaries.
The payment covers 183 thousand processes that have already been closed, with no possibility of appeal. The release is part of a larger batch, worth R$2.8 billion, which also includes food actions involving federal public servants. In total, 236,603 beneficiaries in 187,472 processes will be paid in this batch.
Who is entitled to receive it?
Anyone who won a lawsuit against the INSS related to the granting or review of benefits, such as:
- Retirements (by age, contribution time, disability or person with a disability);
- Death pension;
- Temporary Disability Benefit (former sickness benefit);
- Continuous Payment Benefit (BPC).
To receive this payment, you must:
- The process is completely closed (has become final);
- The amount is up to 60 minimum wages (R$91,080 in 2025);
- The judge’s payment order was issued in November 2025.
Payments are made through small value requisitions (RPV), a mechanism used to settle court debts of lower value in a shorter period of time than traditional court orders.
When does the money hit the account?
RPVs must be paid within 60 days of the judge’s payment order. The deposit is made into an account opened at Banco do Brasil or Caixa Econômica Federal, in the name of the beneficiary or his lawyer.
Before payment, the process goes through a processing phase, when accounts are opened. After the deposit, the court system starts to indicate the status “Paid in full to the court”.
How do you know if you will receive it?
The query must be made on the website of the Federal Regional Court (TRF) responsible for the process. You can search using:
- Individual Taxpayer Registration Number (CPF) of the beneficiary;
- Process number;
- Lawyer data, such as registration number with the Brazilian Bar Association (OAB).
In the “Value entered in the proposal” field, the amount to be paid appears. The acronyms indicate the modality: small value request (RPF) or precatório (PRF).
Difference between RPV and precatório
- RPV: up to 60 minimum wages, paid within 60 days after the court order;
- Precatório: above this limit, paid once a year. The 2025 federal court orders were released in July.
Can heirs also receive it?
Heirs of deceased beneficiaries are entitled to the arrears, as long as they prove the legal link and qualify in the process. In case of doubt, the advice is to contact the lawyer involved in the action or the Federal Public Defender’s Office.
