The legal action promoted by Castillo’s lawyers sought to order his release to receive specialized medical care, alleging an alleged health problem that would require treatment outside the prison where he is being held for various criminal proceedings. It was also requested that, after the intervention, he be allowed to serve the detention measure at home under medical and family supervision.

However, in its resolution the TC concluded that the lawsuit did not prove a violation of fundamental rights, such as the right to health or protection against unreasonable treatment in the context of his imprisonment. For that reason, it decided to reject the appeal and declared the request for release and change of custodial measure unfounded.
“This Constitutional Court declares that the violation of the rights to health has not been proven and that he is not subject to treatment lacking reasonableness and proportionality with respect to the form and conditions in which Pedro Castillo Terrones fulfills his confinement under a court order and the administration of the INPE,” the resolution reads.
Judiciary rules out coup d’état and ratifies conviction against Pedro Castillo only for conspiracy
On Thursday, December 4, during the reading of the sentence, the Judiciary determined that the announcement of the closure of Congress on December 7, 2022 did not constitute rebellion and confirmed that Pedro Castillo’s criminal responsibility corresponds only to the crime of conspiracy.
In its resolution, the Special Criminal Chamber of the Supreme Court confirmed the sentence imposed on the former president for 11 years, 5 months and 15 days in prison, in addition to 2 years of disqualification so that he cannot hold public office. At the same time, the PJ annulled the most severe accusations attributed to him such as a coup d’état and abuse of authority for which the Prosecutor’s Office initially requested a sentence of 34 years in prison.
