The Board of Directors of the Lima Bar Association expresses its concern about the Fifteenth Provision of Law No. 32515, Debt Law for fiscal year 2026, which breaks the principle of internal governance of the Municipal Funds.
The Constitutional Court has indicated that the Budget Law, and therefore the Debt Law, is temporary and must regulate that specific matter.
In that sense, the CAL warns that the provision violates Article 60 of the Constitution by imposing a government director in the CMACs, affecting their institutional autonomy. Likewise, it announces corresponding unconstitutionality action.
