Delia Espinoza after debate in Congress: "It is a political persecution"

The Permanent Commission of the Congress of the Republic is debating the final report of the Subcommittee on Constitutional Accusations (SAC) that proposes disqualifying the former prosecutor of the nation for constitutional violation Delia Espinoza for a period of 10 years. This will be voted on today in the same working group.

Upon leaving the session, Espinoza declared before the press and assured that the complaint responds to political persecution: “It must be based on legal aspects, not only on a matter of revenge, of retaliation against me for having done my job neatly.”

He stated that the Public Ministry is only “requiring”, that is, it requests the initiation of a process to determine responsibility, but does not establish it.

On the other hand, she questioned the claim that she, as the nation’s prosecutor, had “simply stepped aside” regarding the alleged bad decision of congressmen to legislate in favor of pensioners, a fact that, according to Espinoza herself, constitutes a crime and has been demonstrated in the document.

He declared that the congressmen “favored themselves, they know it,” but they seek to “hide that bad decision they made.”

The report – which was approved by the working subgroup chaired by Lady Camones, on December 3 – indicates that Espinoza had committed a constitutional violation by supposedly “violating the basic principles of public exercise and affecting the powers of Parliament.”

This is because the former head of the Public Ministry made accusations at the time against the legislators related to the opinion of the bill that authorized some congressmen to receive, simultaneously, their remuneration and the pension for pensioners of the Armed Forces and the National Police.

According to the letter sent to Espinoza Valenzuela, she will have the opportunity to exercise her right to defense and have a lawyer.

Second disqualification?

It should be noted that Espinoza is currently disqualified from holding public office for 10 years.

The measure was approved at the beginning of the month by the full Congress. On that occasion, 71 parliamentarians supported the report that established that Espinoza incurred a constitutional violation by endorsing the non-application of Law 32130 approved by Congress, which gives the National Police the power to investigate crime and expedite criminal proceedings.

Likewise, it cleared the way for the person who held the highest position in the National Prosecutor’s Office to now be prosecuted by the same institution.

After the measure, Espinoza announced that he will resort to all instances, including international ones, to assert his rights.

“They have trampled on the constitutional rule of law, starting a parliamentary dictatorship. (…) The international community is seeing it and is taking note, my fundamental rights and those of the population to have true justice have been violated with a prosecutor who pursues crime, not names, not parties, but crime at the highest level, the crime of power and I am going to continue doing it because sooner or later I am going to return,” he stressed.
