According to the brief, the attorney considered that said resolutions could “compromise the intangibility of the electoral schedule, by ordering the continuation of the protection process and the eventual issuance of a sentence.”
The TC declared it inadmissible because it exceeds its scope of competence and, therefore, cannot provide details to the order of precautionary measure that has been issued.
Likewise, they specified that the resolutions issued in the Popular Unity case They do not compromise the electoral schedule.

“The precautionary decision issued in the proceedings was limited to suspending the effect of the following resolutions: i) the one that declared the claim founded; ii) the one that ordered the immediate implementation of the sentence; iii) the one that declared the nullity of the actions of the JNE; and, iv) those that imposed sanctions and fines on the members of the JNE and the National Director of the (ROP),” it reads.
In that sense, the supreme body specified that the Judiciary has not “failed to comply or disregard the precautionary measure established in the proceedings, since it has not issued any statement that compromises the electoral schedule.”
“It was expressly established in the records that the precautionary measure granted will maintain its effects until a final ruling is issued in the present jurisdictional process, without the possibility of adopting new resolutions that could compromise the development of the current electoral schedule,” the document adds.
If the PJ eventually issues a resolution that compromises the electoral stages, the TC assured that it “will guarantee, in a timely manner, the development of a democratic, transparent electoral process that respects legal security.”
