JNE makes official the exclusion of Acción Popular from the 2026 general elections

It’s decided. The National Elections Jury (JNE) annulled the primary elections held by Acción Popular for the selection of its candidates, concluding that the process violated essential principles of internal democracy and due process. The decision annuls the elections and makes official the definitive exclusion of the Lampa party from the next general elections on April 12.

The highest electoral body determined that there were serious inconsistencies between the delegates proclaimed as winners by the National Electoral Committee of Popular Action and the list of electoral material prepared by the National Office of Electoral Processes (ONPE). These irregularities occurred in multiple constituencies, including Áncash, Cajamarca, Cusco, Huancavelica, Lima in its various jurisdictions, Loreto, Piura, Tacna and Ucayali.

According to the resolution published in the official newspaper El Peruano, the JNE had previously warned the ONPE about observations made by its inspectors, which warned that people who had not been elected on November 30, 2025 would be considered as delegates. Despite this, the primary elections were held without correcting these anomalies.

The ruling highlights that internal democracy is a fundamental pillar of the political system, as it guarantees objective, transparent and participatory candidate selection processes, in accordance with the Constitution, electoral regulations and the party statutes themselves. The transgression of these principles, warns the JNE, invalidates the process as a whole.

In addition, the electoral body specified that, due to the deadlines of the electoral schedule, it is not feasible to call new primary elections. Any attempt to do so would imply breaking the legal milestones established by Law 32264, in particular that of December 7, 2025, and would put at risk the official proclamation of results scheduled for December 15. Thus, Acción Popular will not be able to appeal this decision and will only be a spectator of the next electoral process.

The JNE, through its general secretary, Elisa Clavijo, assured that it did not exceed its functions by declaring the annulment of the internal elections in Acción Popular. The official pointed out that the entity acted within the powers granted to it by the Constitution and the Law of Political Organizations, after evaluating the annulment requests presented by various instances due to serious defects detected in the internal electoral process.
