Carla Zambelli resigns from her mandate; Chamber will swear in the substitute

With the resignation, the president of the Chamber, Hugo Motta (Republicanos-PB), must swear in this Monday (15) the deputy of the parliamentarian, Adilson Barroso (PL-SP).

Zambelli leaves office two days after the Federal Supreme Court (STF) confirms the immediate revocation of mandate her.

On Friday (12), the First Panel of the Supreme Court unanimously confirmed the decision of Minister Alexandre de Moraes who annulled the vote of the Chamber of Deputies that rejected the revocation and maintained the deputy’s mandate.

Last Wednesday (10), the Chamber decided to maintain Carla Zambelli’s mandate by a score of 227 votes in favor and 110 against. 257 votes were needed to approve the impeachment.

In view of the deliberation that maintained the parliamentarian’s mandate, Alexandre de Moraes decided to annul the House’s resolution that made the result of the vote official.

The minister said that the decision is unconstitutional. In Moraes’ understanding, the Constitution defined that it is up to the Judiciary to determine the loss of mandate of a parliamentarian convicted by a final and unappealable decision, with the Chamber only being responsible for “declaring the loss of mandate”.

Escape

In July this year, Zambelli was arrested in Romein Italy, where he tried to escape the execution of an arrest warrant issued by minister Alexandre de Moraes.

Because she has dual citizenship, the deputy left Brazil in search of political asylum in Italy after being sentenced by the STF to 10 years in prison for the invasion of the electronic system of the National Council of Justice (CNJ), in 2023.

The final decision on the extradition process carried out by the Brazilian government will be taken at an Italian court hearing next Thursday (18).
