Congress approves in first vote granting powers to the Executive

He Congress Plenary approved in the first vote to grant the Executive power powers to legislate on matters of citizen security, economy and institutional strengthening. The decision came after the presentation of the proposal by the government on November 20.

The document was approved by 69 votes in favor, 31 against and three abstentions. However, a second vote will be required after seven calendar days.

The replacement text states that “the measures issued within the framework of the provisions of this law do not affect the autonomy and powers of the Legislative Branch, regional and local governments or the autonomous constitutional bodies recognized by the Constitution.”

Likewise, it indicates that “they do not violate fundamental rights nor do they affect pending judicial processes. Failure to comply with the provisions of this provision generates political or functional responsibility, as appropriate.”

Among the measures contemplated by the Executive is the creation of the Specialized Subsystem against Extortion and its Related Crimes (SEEDC). In addition, an attempt will be made to modify Law 30096, Computer Crime Law, to incorporate as crimes the conduct linked to the acquisition, commercialization and trafficking of computer data, data banks, among others that are illegally obtained.

The document also contemplates establishing rules, measures and/or mechanisms for the proper use of numbering in calls and text messages and their traceability, in order to avoid anonymity and illicit communications to the detriment of users of public telecommunications services.
