The suspended fiscal of the Nation, Delia Espinozadisqualified for 10 years, denounced retaliation for not handing over her position to Patricia Benavides and called the decision a “direct message” to intimidate all the country’s prosecutors. He also questioned the “total silence” of the president of the Judiciary, Janet Tello.
After the approval by Congress of disqualify her from holding public office for ten yearsEspinoza, gave a press conference in which he harshly attacked the Legislative Branchwhom he accused of consummating the “takeover” of the Public Ministry.
“Our Public Ministry has just been taken,” he stated, also describing the congressional decision as “one misdeed after another.”
Disqualification as retaliation for Benavides
The supreme prosecutor stated that her disqualification is a direct consequence of his refusal to submit to political pressure. In his words, he is being sanctioned for not having obeyed the “orders to strip myself of my position as prosecutor of the Nation and hand it over to the then dismissed Patricia Benavides Vargas.”
Espinoza interprets the actions of Congress as an attempt at general intimidation. He maintained that the measure is a “direct message to all regular and non-regulatory prosecutors… to submit, to be afraid.”
“Not for me, not for Delia Espinoza, but for the institutions, for respect and defense of the autonomy of the Public Ministry,” he added, calling on prosecutors to react.
Criticism of the Silence of the Judiciary
The former head of the Public Ministry also directed her criticism at the president of the Judiciary, Janet Tello, for not speaking publicly about this case.
“Those institutions are taken, the Judiciary seems to… because there is total silence on the part of its president, whom I have publicly asked to speak out,” he indicated.
Despite the disqualification, Delia Espinoza assured that she feels like the “legitimate prosecutor of the Nation,” a position currently held on an interim basis by Tomas Gálvez. He warned that the Supreme Board of Prosecutors would be validating the “unconstitutionality” if it appoints a new prosecutor.
Furthermore, without any evidence he claimed that fraud was being prepared for the next presidential and parliamentary elections.
Finally, he reiterated that he will present an amparo action before the Judiciary, in addition to complaints for alleged violations of the Constitution, to reverse the decision of Congress.
