The project seeks to apply this legal figure to the facts or crimes related to that event, which, if the law is approved, would not be susceptible to investigation or process, ordering the definitive archive of all cases pending before the Public Ministry or the Judiciary.

What happened on December 7?
The message to the Nation to which the project refers was the act in which the then president Pedro Castillo Terrones tried to commit a self-coup d’état. In said speech, Castillo announced the unconstitutional dissolution of the Congress of the Republic, the intervention of various institutions of the justice system (such as the Judiciary, the Public Ministry, the JNJ and the TC), and the imposition of a nationwide curfew.
Currently, former President Castillo has been sentenced to 11 years, 5 months and 15 days for the crime of conspiracy to rebel as a result of this attempt to break the constitutional order.
It should be noted that the amnesty would apply specifically to crimes of rebellion and seditionbut would be excluded from any other investigation that former President Castillo may face, such as those related to alleged criminal organization or influence peddling.
The bill focuses on “granting criminal forgiveness to those involved in the events related to the message to the Nation of December 7, 2022.”
Justification of the bill
The main justification that supports the initiative focuses on the search for reconciliation and stability in the country.
According to the document, the amnesty “seeks to overcome political divisions and tensions, promoting a climate of peaceful coexistence and constructive dialogue.” In addition, he argues that the measure would contribute to general political stability by avoiding “prolonged legal processes that generate uncertainty” in the political sphere.
Congressman Bellido has publicly stated that the initiative seeks to promote peace and guarantee the economic development of the country.
Alejandro Muñante against the bill
Given the statements of his colleague Bellido, parliamentarian Muñante of the Popular Renewal bench did not hesitate to speak out against the bill: “In no way, I do not think that is appropriate. If it is seen in the Constitution Commission, we will vote against a position of that nature.”
