Public Ministry will appeal sentence against Alexis Medina

SANTO DOMINGO.- The Public Ministry reiterated that it will appeal the sentence handed down in the process followed against Juan Alexis Medina and shares, whose deadlines began to run for all parties as of this Wednesday with the notification of the full decision, of 10,841 pages, in digital format.

“The parties, including the Public Ministry, agreed with the notification in digital format. It is worth noting that we are pioneers in the use of electronic devices for the delivery and notification of evidence collected in investigations,” said prosecutor Elizabeth Paredes Ramírez, who received the USB device with the decision issued by the Second Collegiate Court of the National District, made up of judges Claribel Nivar, Giselle Soto and Clara Castillo.

The presiding judge, Claribel Nivar, explained in detail the procedure for accessing the device and the stored content. Subsequently, the clerk of the court proceeded to verify and open the USB device, informing all parties of all the information included.

“Although at the time there were discussions with some defenses, the judges have assumed this modality as part of the new virtual reality,” explained prosecutor Paredes Ramírez, attached to the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (Pepca).

He pointed out that this modality, with a duly identified and sealed USB, represents a significant advance in the modernization of the justice system, because it speeds up notification, increases security and reduces the use of paper.

During the event, Juan Alexis Medina did not appear.

Court decision

In the process, Medina Sánchez, who led the corruption network, was found guilty of bribery in trade and investment, money laundering, use of false documents and association of criminals, for which he was sentenced to seven years in prison.

The court also sentenced José Dolores Santana Carmona to 6 years in prison and 5 years to Wacal Vernabel Méndez Pineda, Francisco Ramón Brea Morel, Carlos Martín Montes de Oca, Rigoberto Alcántara Batista and Paola Mercedes and Víctor Matías Encarnación.

The defendants Medina Sánchez, José Dolores Santana Carmona, Wacal Vernabel Méndez Pineda, Paola Mercedes and Rigoberto Alcántara Batista and several companies must pay 500 million to the Dominican State.

Also, the companies Domedical Supply SRL; Fuel American Inc.; General Supply Corporations SRL; General Medical Solution AM SRL; Kyanred Supply SRL; Suim Institutional Suppliers Méndez SRL; United Suppliers Corporations SRL; WattmaxDominicana SRL; WMI International SRL; Wonder Island Park SRL; Acorpor SRL; Ichor Oil SRL; Globus Electrical SRL; You hire SolutionServices CSS SRL; Constructora Alcántara Bobea (CONALBO) SRL; Engineering & Construction Projects PIC SRL; Reivasapt Investment SRL; Suhold Transport and Logistics SRL.

Juan Alexis Medina Sánchez and the other convicts must serve their prison term in the Najayo Hombres and Najayo Mujeres correction and rehabilitation centers, in the San Cristóbal province, in addition to paying the criminal costs of the process.

By virtue of the agreement he reached with the Public Ministry, the defendant Víctor Matías Encarnación Montero was found guilty and sentenced to 5 years in prison, with the court ordering the suspension of the sentence, subject to rules, among which are residing at the address that was notified to the court. He was also sentenced to pay criminal costs and a fine of 500 thousand pesos.

Both Fernando Rosa, Carmen Magalys, Freddy Hidalgo, Rafael Antonio Germosén Andújar, Lina Ercilia de la Cruz Vargas, Pachristy Emmanuel Ramírez, Carlos José Alarcón, Libni Arodi Valenzuela Matos, José Miguel Genao Torres, Antonio Florentino Méndez, José Idelfonso Correa Martínez, Aquiles Alejandro Christopher Sánchez and Fulvio Antonio Cabreja Gómez were acquitted

Also, the companies Cemeraf and Editorama were acquitted of money laundering and released from paying the criminal costs of the process.

Regarding Alexis Medina, the Public Ministry established that the accused, using different companies in violation of Law 340, obtained countless contracts, the events have an impact on the Ministry of Public Health with high-cost medications, hospital equipment, on the Ministry of Public Works with asphalt material, and the participation of purchases in EdeEste. In the National Police with fuel for more than 220 million of which they did not deliver an approximate of 32 million.

The court was able to verify that the company Fuel América lacked basic requirements to participate in the purchasing process to supply fuel to the National Police.

In addition, it confirmed and verified the involvement of different National Police bombs that complete the more than 32 million that the Public Ministry indicated in its accusation.

In the reading, it was highlighted in relation to the National Police: “The anomalies that the court identified are astonishing.”

Also, it was confirmed that bribes were given in the Rural and Suburban Electrification Unit (UERS).

The judges rejected the exclusion of evidence provided by the prosecuting body, establishing that due process of law was complied with in its collection.
