The former president Martin Vizcarra He must face a new trial for alleged simple collusion in the Lomas de Ilo and Hospital de Moquegua cases, the same ones for which he was recently sentenced to 14 years in prison.
As is known, Viscarra was recently sentenced to 14 years in prison for the crime of passive bribery after confirming that he received S/ 2.3 million in bribes from the construction companies Obrainsa and ICCGSA in exchange for favoring them in the tenders for the Lomas de Ilo and Moquegua Hospital projects.
Now, the National Superior Court of Specialized Criminal Justice has opened a new trial against Martín Vizcarra, this time for the alleged crime of simple collusion in the same cases. The Fifth National Preparatory Investigation Court has issued the prosecution order for which they are now asking for 10 years in prison in this new process.
The crime of simple collusion occurs when it is proven that there is an agreement to defraud the State in public contracts, without the need for the agreement to have been executed.
This new trial worsens the situation for Vizcarra, who has already spent his first night in Barbadillo prison. The prosecution order specified that the process progressed in accordance with articles 351, 359, 361 and 362 of the Criminal Procedure Code.
The resolution also highlights that the preliminary debate was exhausted, the accusation was formally and materially validated and the evidence offered by both parties was admitted. Consequently, and under these parameters, the judge ordered to send the proceedings to the body in charge of directing the new oral trial in the case.
BACK ON THE DOG
Martín Vizcarra will now sit on the dock again in order to respond in this new trial for which the Public Ministry requests 10 years in prison and the payment of civil compensation.
The prosecution maintains the thesis that Vizcarra intervened in decisions that favored a construction consortium during his management as regional governor of Moquegua.
