Martín Vizcarra will face Congress from Barbadillo: the four constitutional complaints against him

Martin Vizcarra will face a new phase of political and judicial tensions from the prison of Barbadillo. Although he is already serving a 14-year sentence for corruption – for the Lomas de Ilo and Hospital de Moquegua cases – he still has four constitutional complaints against him. Vaccine Case: Final report with accusation against Vizcarra was approved by the SAC

The accusation against Martín Vizcarra for the Vacunagate case took a decisive step on November 5, when the Subcommittee on Constitutional Accusations (SAC) of the Congress of the Republic approved the final report that recommends charging him with the alleged crime of concussion. The decision was adopted with 11 votes in favor, 2 against and 1 abstention.

According to the report presented, the accusation indicates that, when Vizcarra was president, he requested doses of the Sinopharm vaccine candidate for himself and his close environment, taking advantage of his position to obtain an improper benefit. This action, according to the SAC, would violate the principle of equality before the law by privileging a small group outside the official protocols of the vaccination campaign.

After approval of the report, the file must be sent to the Permanent Commission of Congress, which will decide whether to designate an accusatory subcommittee to support the complaint before the Plenary. If the plenary session approves the accusation, Vizcarra could face additional sanctions, despite the fact that he is currently serving a criminal sentence, which further complicates his legal and political situation.

Generic falsehood: links with Odebrecht and CyM Vizcarra SAC

According to the Prosecutor’s OfficeMartín Vizcarra would have omitted to record relevant information about his links with companies related to the Odebrecht case and with CyM Vizcarra SAC This omission, if proven, would delegitimize key statements within the investigations linked to corruption.

The file, registered with code 24-2019, was already in progress before the recent conviction against him. Although the sentence for bribery has already been carried out, the constitutional complaint continues to be processed independently. That is to say: the conviction does not invalidate it or resolve it.

Currently, the complaint is in the hands of the Subcommittee on Constitutional Accusations of the Congresswhich must evaluate whether the evidence is sufficient to formalize a political accusation. His ruling could set a precedent on the legal responsibility of former presidents for omission of information.

Aggravated collusion: purchase of rapid tests during the emergency

In 2025, the Prosecutor’s Office filed a new constitutional complaint against Vizcarra, linked to the acquisition of rapid tests for COVID-19. The accusation maintains that the purchase would have been made with irregularities: lack of technical criteria, favoring of specific suppliers and cost overruns. The crime charged: aggravated collusion.

According to the file, the contracts were signed with companies linked to the former president’s environment. The strategy would imply an improper granting of state contracts, with damage to the State coffers and possible non-payment to the most vulnerable population.

That case is under parliamentary analysis. If the Subcommittee approves it, it will go to the Plenary Session of Congress. The political burden is high: public management is questioned in the midst of a health crisis.

Criminal organization: “The Untouchables of Corruption” case

The most serious complaint points to the existence of an alleged corruption network led by Vizcarra, under the name Los Intocables de la Corrupción. The Prosecutor’s Office accuses him of integrating—and possibly heading—a structure that favored illicit awards of public works during his administration, with million-dollar contracts secured.

The file combines crimes of criminal organization with simple and aggravated collusion. It includes evidence of directing of bids, predetermined beneficiaries and absence of real competition, which would violate the State contracting law.

Although the justice system has already convicted him of bribery in specific projects, the criminal network accusation continues its course along constitutional lines. If he Congress decides to move forward, the seriousness of this case could accentuate the legal and political consequences for Vizcarra, even from prison.
