Minister Alexandre de Moraes, of the Federal Supreme Court (STF), determined this Tuesday (25) that the Military Justice and the Military Public Ministry (MPM) be informed about the execution of the convictions of former president Jair Bolsonaro and other Armed Forces soldiers in the criminal action of the coup plot.
With the declaration of final and unappealable convictions and the arrests of the accusedthe former president, who is an Army reserve captain, generals Augusto Heleno, Paulo Sergio Nogueira, Braga Netto and Admiral Almir Garnier should be the target of an action to lose their official status and will be tried by the Superior Military Court (STM).
“Let the presidency of the Superior Military Court and the Attorney General’s Office of the Military Public Prosecutor’s Office, in accordance with art. 142, paragraph 3, VI and VII, be requested to decide on the loss of the post and patent of Jair Messias Bolsonaro”, the minister dispatched.
According to the Constitution, an Armed Forces officer can be expelled from the forces in the case of a criminal conviction exceeding two years’ imprisonment for a criminal conviction.
There is no deadline for the Military Public Ministry to request the loss of patents from the STM.
