Divorce keeps the 400-home project in La Romana paralyzed, buyers denounce

The Roman.- Buyers and co-owners of a project of 400 homes in the province of La Romana reported a serious and shameful abuse pseudolegal that has prevented hundreds of working families who bought and paid for their homes with sacrifice from receiving them. The situation has also forced the company to completely stop its operations, leaving employees, workers and suppliers in a critical economic and labor situation.

They explained that a set of abusive and inappropriate judicial maneuvers, completely outside the law, has dragged Real Estate Don Juan to a private process of which it is not part. They affirmed that these actions undertaken by people accustomed to using the courts as tools of pressure, have been declared by several courts as reckless litigants.

The affected families are, for the most part, working people, teachers, public and private employees, small business owners and professionals who have managed to put together the down payment on their home with effort. Many already have approved loans from financial institutions, others are already paying interest, and several live in rented houses while they wait for the delivery of the home of their dreams.

An absurd legal process that should never have existed

The jurist Dionisio Ortiz explained that the conflict arose because Inmobiliaria Don Juan, the company that owns the land and promoter of the project, was included in the process of separation of assets as part of the still unconcluded divorce process between Mr. Juan Rafael Llaneza and Mrs. María Amelia Hazoury, daughter of Mr. Abraham Hazoury.

“They have turned inappropriate actions processed before Dominican and foreign courts into an instrument of pressure and economic blockade, filing processes without legal basis with the sole purpose of affecting the personal and professional stability of Mr. Llaneza. And it is for this reason that both Mrs. María Amelia Hazoury and her lawyers from the León & Raful office, Mariel León Lebron, Lilia Fernández León and Joel del Rosario Albuquerque, have been declared several times as reckless litigants,” he emphasized.

Families affected by the process.

He explained that they have undertaken these actions despite the fact that Mr. Llaneza is not a direct partner of that company, and that this real estate asset has belonged to his maternal family for more than 100 years, that is, before Mr. Llaneza was born. “And the law is clear about this: inheritances do not enter into the common property of the spouses”accurate.

He pointed out that the assets of Inmobiliaria Don Juan are independent and that this has been recognized in a categorical and coherent manner by three instances: 1) The Presidency of the Civil and Commercial Chamber of the Court of First Instance of the National District 2) The Second Chamber of the Civil and Commercial Chamber of the Court of Appeal of the National District and 3) the Superior Land Court, Central Department.

“The actions promoted by Mrs. Hazoury are unacceptable and lack a legal basis. We fully trust that the Dominican justice system will act with the responsibility that this case demands, and that the judges, faithful to their constitutional role, will guarantee respect for the law, for the decisions already issued and for the rights of the families who are unjustly affected third parties, who today await a timely response,” he concluded.

Families victims of inappropriate litigation

One of the victims is Gilberto Guerrier Batiste, a teacher and district technician of the 05-11 educational district, as well as a professor at several universities. At 40 years old, he is the breadwinner of a home with three small children and a wife who is also a teacher. In 2024, both made the biggest sacrifice of their lives to buy their own home, with delivery scheduled for March 2025. But the date came and went, and the only thing they have received is uncertainty.

With a broken voice, he calls for justice because – he affirms – he is being a victim of an unrelated situation and today “his family and his children are paying and we are now almost on the street and we don’t know what to do.” “Please come and help us, come help us, give us the document so that we can have our little house and that now in December we can give thanks to God in this house and celebrating Christmas,” he exclaimed.

Carmen Rosario, a 32-year-old fifth grade teacher, mother of three children and dedicated wife, experiences the same thing. In 2024, she and her husband bought their home, with a delivery date scheduled for March 2025. But that illusion stopped. Despite having complied with each payment and having a pre-approved loan, the legal obstacles in the process have prevented them from receiving the house they dreamed of as their family refuge. Today, he only asks to be allowed to move into his home and close a year that has been one of anguish, uncertainty and emotional burden for his entire family.

“At the moment I am a victim of justice and I want this to be resolved, because this year, this Christmas, I want to eat my dinner with my children, with my family, in my house. I am not guilty of anything. It is the responsibility of justice that I am in this process right now and that I am not in my house,” she expressed moved.

Another case is that of Irving Batista, 35 years old, private employee, married and father of a small child, whose wife is pregnant. He already lives in the Don Juan project and describes that home as the place where his family has begun to build a stable and happy life. With the hope of providing more space for his family, he decided to acquire additional land to annex as a patio. However, he has not been able to receive the land, but the bank loan is already running out, along with the interest he pays each month without receiving a response.

Co-owners ask to honor their commitments

The co-owners of Inmobiliaria Don Juan, SRL, Coral Llaneza and Clarisa Gil Battle, expressed their deep concern and reiterated their commitment to each of the families that trusted the company. They said that it is unacceptable that a personal process is used to harm people outside the conflict, who only want to buy a roof for their family.

Clarisa Gil Battle, co-owner and mother of Juan Llaneza explained that this property has belonged to her family for more than 100 years, so it is impossible for it to enter into the distribution of assets when the divorce process between María Amelia Hazoury and her son is concluded. “Juan Rafael’s great-grandfather, that is, my grandfather Juan Gil Rivera, acquired those properties before our son Juan was born, that is, there is no way that it can be considered that these assets should enter into a partition,” he stated.

Meanwhile, Coral Llaneza made a firm and respectful call to Dominican justice. “What we ask is simple and fair: that justice acts and the mandate of the law is truly fulfilled, without abuses or influence peddling. And that they let us deliver these homes, honor our commitments and restore hope to the families who trusted us.”
