He Congress Plenary approved on Thursday, in the first vote, the opinion that establishes Saturday as a compensable non-working day for workers whose religious denomination considers that day as a day of rest.
The initiative is based on Bill 4610/2022-CR, presented by Congressman Juan Burgos Oliveros. The proposal obtained 68 votes in favor, 2 against and 19 abstentions. In accordance with article 78 of the Congress Regulations, the opinion must be submitted to a second vote after seven calendar days.
According to the legal formula, at the beginning of the employment relationship the worker must inform the employer of the religious denomination to which he belongs and, if his day of rest is on Saturday, comply with the provisions of article 1. Religious belonging must be accredited by means of a certificate issued by the respective authority.
The opinion also specifies that the hours stopped working during the day of rest will be compensated within the following ten calendar days, or at the opportunity determined by the employer.
Finally, the nullity is declared of any clause in collective agreements, individual agreements or unilateral decisions of the employer that establish discriminatory conditions, direct or indirect, for reasons of religion in matters of remuneration, working hours or other working conditions.
