Executive makes official rule to suspend mobile lines linked to crimes

He Executive power This Friday, Supreme Decree No. 018-2025-IN was made official, which establishes the guidelines for the temporary withdrawal or suspension of mobile public services and the blocking of terminal equipment linked to the commission of crimes.

The decree, endorsed by the president of the Council of Ministers, the Minister of Justice and the Minister of the Interior, provides that entities such as the Ministry of the Interior, the National Police, the Public Ministry, the Judiciary, the National Penitentiary Institute and Osiptel coordinate directly to execute blockades and suspensions.

Procedure

The competent entities, such as the Ministry of the Interior, the National Police of Peru (PNP), the National Penitentiary Institute (Inpe), the Public Ministry and the Judiciary, must designate, within a maximum period of two business days, the officials responsible for sending reports on public mobile telecommunications services and/or mobile terminal equipment for which deregistration or blocking is requested.

These reports must be sent through the information transmission system implemented by Osiptel, stating at least the requesting entity and the linked crime.

Once the report is received, Osiptel has a maximum of one calendar day to request the corresponding operating company to execute the requested measure. The operator, in turn, must comply with the cancellation of the service or the blocking of the terminal equipment within a period of no more than one calendar day from receiving the request.

Subsequently, the agency informs the requesting entity about the result of the measure carried out and keeps a detailed record of all requests for cancellation or blocking, including information on their compliance.

Likewise, the rule establishes that the Ministry of the Interior, the PNP, the Inpe, the Public Ministry and the Judiciary must implement service channels to receive duly justified objections from subscribers who question the cancellation of the service or the blocking of their mobile terminal equipment.

In parallel, the PNP establishes a formal communication channel with Osiptel to verify the authenticity and validity of the complaints and findings presented by users or subscribers. Through this mechanism, Osiptel validates the information received and, if correct, requests the operating company to block the terminal equipment or temporarily suspend the service.

If the documents are not verified, the user’s or subscriber’s request is rejected.

The implementation will be carried out with the institutional budget of the specifications involved, without demanding additional resources from the Public Treasury. The decree and its guidelines were published in the Official Gazette El Peruano and on the State’s digital platforms.

The rule is part of the modifications introduced by Legislative Decree No. 1596, which reinforces measures against the use of cell phones in crime.
