The control entity pointed out cost overruns, unsupported payments and failures in execution in Risk Management Fund contracts.
The Comptroller General’s Office imputed fiscal liability for $9,573 millions in a process related to the purchase of the first 40 tank trucks acquired by the National Fund for Disaster Risk Management (FNGRD) from the company Impoamericana Roger SAS
According to the organization, the company “overestimated the value of the vehicles in the quote and did not perform obligatory services”while some payments were made “without compliance supports existing.” The cars were also received in January 2024, despite the fact that they should have been delivered in November 2023.

In this case, the control entity decided to allocate tax liability by way of fraud against the supplier company. They were also linked Olmedo de Jesús López Martínez, former director of the UNGRD, and Sneyder Augusto Pinilla Álvarez, former deputy director for Disaster Management.
The Comptroller’s Office highlighted that the FNGRD did distribute the vehicles in 2024 and that they are currently providing service, so filed the action related to the failure to comply with the social purpose of the contract.

The calculation of the detriment took into account refunds made in the criminal process carried out by the Prosecutor’s Office. After these payments, the possible damage was $1,708 million, corresponding to the highest market value paid for the vehicles.
Irregularities in second contract for another 40 tank cars
In another process, the Comptroller’s Office imputed fiscal liability for $12,579 million for irregularities detected in the purchase of another 40 tank cars acquired through a Supply Order signed between the FNGRD and the Mixed Corporation for Sustainability and Comprehensive Social Development – Yapurutú.
This contract was carried out within the framework of compliance with Ruling T-302 of 2017 of the Constitutional Court, which ordered urgent actions to guarantee access to water in La Guajira and serve the Wayúu population.
The Comptroller’s Office pointed out the existence of “ineffective, inefficient and uneconomic fiscal management”, which would have resulted in detriment due to cost overruns compared to market prices, payments for maintenance “that were not effectively provided” and additional values due to failures in the planning and execution of the contract.
In this process, Olmedo de Jesús López Martínez, Sneyder Augusto Pinilla Álvarez, and Corporación Yapurutú as supplier were held responsible by way of serious negligence.
The organization decided to archive the action in favor of Carlos Alberto Carrillo Arenas, current director of the UNGRD, upon verifying that the contracted tank trucks are already in operation.
