The municipal institution assures that it is one of the authorizations of discovery broader awards granted in USA in a case about alleged corruption in a concession. According to the municipality, the American court order allows access to banking and clearing records related to Brookfield Asset Management, Scotiabank, KPMGinternational banks, as well as the main United States interbank clearing network (CHIPS system) and the Federal Reserve Bank of New York.
Said information may be obtained through formal subpoenas.
“The decision will allow us to accurately reconstruct the flow of funds between 2013 and 2016, periods in which Odebrecht operated its system of “structured operations” and Brookfield acquired the majority stake in Rutas de Lima,” said the MML.
Along the same lines, the MML stated that no Peruvian institution had previously accessed financial information at this level within the US banking system in the framework of an anti-corruption investigation.
“This decision places Lima at the forefront of the global fight against corruption and opens an effective path to clarify the truth about the origin of the concession,” the municipality highlighted and then added that this access will allow to independently verify the existence or absence of improper payments, suspicious transfers or irregular financial movements related to the granting of the concession or its subsequent transfer to Brookfield.
For its part, the Federal Court argued its decision in the urgency generated by the beginning of the oral trial against the former mayor of Lima, Susana Villaran and recognized the legitimacy of the public interest in accessing key banking information within the USA.
Judicial Power ratifies that Rutas de Lima must suspend toll collection in Villa and Punta Negra
At the beginning of November, the The Judiciary ordered the Rutas de Lima company to suspend the collection of tolls with immediate effect in the areas of Villa and Punta Negra, after accepting the request presented by the District Municipality of Santa María del Mar.
Judge Patricia Romero Medina, of the Preparatory Investigation Court of Pachacamac, determined that the sentence of October 13, 2025 must be executed immediately, without waiting for the result of the appeal presented by Rutas de Lima. According to the judge, this action does not generate an irreversible situation nor does it cause disproportionate damage to the company, since toll collection could resume if the ruling is revoked.
The judicial resolution highlights that the maintenance of toll collection in Villa and Punta Negra infringes the freedom of movement of residents of the south, who, due to the absence of alternative routes, are forced to pay to leave their homes. Consequently, the judge determined that the economic damage alleged by the concessionaire cannot prevail over this constitutional right.
