Judge stops process against someone involved in the fiscal huachicol

Anatalía Jocelyn Gutiérrez Gutiérrez, former verifier at the National Customs Agency and involved in a fuel smuggling network, known as huachicol fiscal, obtained a definitive suspension that stops for the moment the trial against him for organized crime for the purpose of committing crimes in the field of hydrocarbons. The precautionary measure does not imply that he regains his freedom.

According to investigations by the Attorney General’s Office, she allegedly received bribes to allow the entry of fuel shipments on ships that were falsely declared as other products in order to evade taxes.

The network was led by senior naval officers, including Vice Admiral Manuel Roberto Farías Laguna, prosecuted for the same crime, and his brother Admiral Fernando Farías Laguna, the latter a fugitive from justice. Both are political nephews of the former head of the Mexican Navy Secretariat, Admiral José Rafael Ojeda Durán.

Two months ago, Gutiérrez Gutiérrez, along with 13 other members of the corruption network, representatives of customs companies and Customs officials, were arrested and subject to criminal proceedings for organized crime and illicit acts in the field of hydrocarbons, all for participating in the corruption network that made it possible for 32 ships to smuggle millions of liters of fuel from the United States to Mexico.

However, Anatalía Jocelyn Gutiérrez Gutiérrez promoted an amparo trial against acts depriving her of her liberty and the order of connection to the process last September issued in criminal case 325/2025, by a control judge of the Federal Criminal Justice Center in the state of Mexico, with residence in Almoloya de Juárez.

In this regard, the amparo judge granted the definitive suspension so that in the event that the trial reaches the intermediate stage, the control judge, once concluded, does not order the opening of the trial stage, as long as the present trial is not resolved in the main matter; That is, until they determine whether to grant protection to Gutiérrez.

The judge pointed out that the precautionary measure decreed does not have the effect of completely paralyzing the continuation of the corresponding criminal procedure, since we are faced with a situation of public order and social interest in respect to which the requested suspension is legally prohibited.

Likewise, the judge scheduled the constitutional hearing for next December 10 when he will determine whether to grant him the protection of federal justice.
