The Attorney General of the Republic, Paulo Gonet, sent this Tuesday (18) to the Federal Supreme Court (STF) an opinion against the extinction of the sentence of Army lieutenant colonel Mauro Cid, Jair Bolsonaro’s former aide-de-camp.
Cid was sentenced for the coup plot to two years in open prison and was guaranteed his right to freedom under the plea agreement.
According to his defense, he has already served his sentence while he was preventively detained during investigations and should have his sentence extinguished.
In the opinion sent to the STF, Gonet said that the sentence must be maintained regularly because the soldier has not yet served his sentence.
“In the case under analysis, Mauro Cesar Barbosa Cid remained in pre-trial detention on two occasions: between 3.5.2023 and 9.9.2023 and between 22.3.2024 and 3.5.2024, periods that do not reach the two years fixed in his conviction. There is, therefore, no hypothesis of extinction of the defendant’s punishment”, said the prosecutor.
PF Protection
The prosecutor also said that Mauro Cid’s defense should be heard regarding the Federal Police’s (PF) suggestion that the soldier and his family members be included in the federal witness protection program.
“With regards to the inclusion of Mauro Cesar Barbosa Cid and his family members in the Federal Assistance Program for Threatened Victims and Witnesses, the Attorney General’s Office considers subpoenaing the defense, for possible expression of interest”, added Gonet.
At the beginning of this month, when determining the execution of the soldier’s sentence, who signed a plea bargain agreement with the PF, Minister Alexandre de Moraes defined several measures, such as nighttime retirement, prohibition of carrying weapons, using social networks and communicating with those investigated in the processes regarding the coup plot.
Furthermore, the minister authorized the PF to carry out actions to maintain the safety of Mauro Cid and his family.
