Congress formalizes regulations for the return to bicameralism in 2026

The Congress of the Republic made official this Thursday the regulations that will govern its operation under a bicameral scheme, with Chamber of Deputies and Senate, starting in 2026. The publication was made through legislative resolutions in the official gazette The Peruvian, despite the fact that citizens expressly rejected this reform in the 2018 national referendum.

The three approved documents regulate the operation of the Congress as a whole (153 articles), in addition to that of the Chamber of Deputies (197 articles) and Senate (204 articles). The rules include provisions on internal organization, legislative procedures, oversight and coordination mechanisms between chambers.

The Regulations of the bicameral Congress obtained 79 votes in favor, 20 against and 5 abstentions. The other two regulations were approved with 75 favorable votes each.

Although the parliamentary majority points out that the return to bicameralism will strengthen the “legislative technique” and the control function, this change occurs without citizen consultation.

The December 2018 referendum left a clear message: more than 90% of citizens voted against reestablishing the bicameral system proposed by the then Congress, after considering that it violated the necessary checks and balances and favored the re-election of parliamentarians.

Today, less than a year after the start of the new legislative period, Congress once again approved this change on its own, in the midst of a legitimacy crisis, with disapproval that is around 90% according to surveys.
