The former president Pedro Castillo spoke out after having denounced 100 congressmen who voted in favor of his vacancy and the former president Dina Boluarte for assuming the presidency in December 2022. Through his official X account (formerly Twitter), Castle —who is prosecuted for his coup attempt— defended his complaint filed with the Prosecutor’s Office and targeted those accused of “trampling on the vote” of Peruvians.
“The truth is concrete: Congress did not follow the law nor reach the votes required by its own regulations. 104 votes were needed, but they only obtained 101. Not only did they violate the law, they also trampled the vote of millions of Peruvians,” he said.

In the complaint presented by the defense of the former head of state, he accuses the parliamentarians and the former president of the alleged crimes of abuse of authority, appointment and illegal acceptance of office.
“From my unjust prison, I do not give up nor remain silent. This complaint is for the teacher, the peasant, the indigenous, the worker, the student, the man and woman of the town who continue to resist abuse and lies,” he emphasized.
“I tell you with my heart: dignity is not negotiable. The Peru deep deserves justice, and sooner or later the truth will prevail. “We will return millions and recover the people’s government!” said the former president.

Castillo’s defense, through the lawyer Javier Adrianzenargues that the impeachment process was illegal, since the minimum number of votes required according to the Regulations of the Congress of the Republic.
According to article 89-A, subsection c), of the regulations, a vote of no less than four-fifths of the legal number of members of Congress is necessary to declare a presidential vacancy. This is equivalent to 104 votes, considering that Parliament is made up of 130 members. However, on December 7, 2022, only 101 votes were obtained in favor of impeachment.
Furthermore, according to the document, it indicates that the former president did not exercise his right to defense and did not have a public defender. “I had to maintain my status as president of the republic as I had not yet been immediately vacated with the legal number of congressmen,” he said.
Meanwhile, the complaint against Boluarte, according to the document, is based on the fact that, since Castillo had not been vacated with 104 votes, “the diligent thing was not to accept while respecting the law, so his action – by way of acceptance – is also illicit as established in article 381 of the Penal Code.”
