The annulment of evidence against Nadine Heredia The ruling by the Supreme Court of Brazil does not affect the cases in which the wife of convicted former President Ollanta Humala, currently asylum in that country, is involved in Peru.
The EFE agency reported that, in response to an appeal filed by Heredia’s defense, Judge José Antonio Dias Toffoli ordered the nullification of the evidence that had been extracted from the Drousys and My Web Day computer systems, where the Odebrecht company stored records of bribe payments.
In addition, Dias Toffoli prohibited sharing this documentation via International Judicial Cooperation, an instance that has been suspended between Brazil and Peru since last May.
However, what was decided by the Brazilian magistrate has no implications in Peruvian jurisdictions.
The coordinator of the Lava Jato special team, Rafael Vela, recalled that the Public Ministry already has all the evidence that served, on the one hand, to sentence Humala and Heredia to 15 years in prison for illicit contributions to the 2011 campaign, and on the other, to accuse both of them in the Gasoducto case.
“It has already been proven that none of these sentences have been effective in Peru, it must be taken as a media issue; no Brazilian judge can interfere in Peruvian justice,” he told this newspaper.
Vela, who clarified that he has not received any notification from the Brazilian authorities, stressed that his team does not need to look for evidence abroad “because the processes have already been concluded.”
The former first lady sought refuge in the Brazilian embassy in Lima on April 15, the same day she learned of her sentence for money laundering.
In a matter of hours, Humala’s spouse traveled to the neighboring country, after Dina Boluarte’s government granted her safe passage.
Heredia Alarcón is still being prosecuted for having interceded on behalf of Odebrecht to be awarded the construction of the southern gas pipeline during the Humalist administration (2011-2016).
According to the fiscal thesis, the former presidential couple sought to favor the construction company as gratitude for the US$3 million it paid to finance the proselytizing activities of the Nationalist Party.
