Rapporteur submits PF action against factions at governor’s request

Derrite is dismissed from the São Paulo Security Secretariat

“When there is interstate or transnational repercussion of the facts, with the potential to affect national security or destabilize international public order, the Ministry of Justice and Public Security may, upon provocation from the State Governor, determine the joint or coordinated action of federal and state police forces”, says the project.

São Paulo’s security secretary, Guilherme Derritetook leave from his position to report the PL 5,582 of 2025which entered the agenda of the Chamber of Deputies this Tuesday (11).

The law professor at the Federal University of Rio Grande do Sul (UFRGS) Rodrigo Azevedo, associate of the Brazilian Public Security Forum, assesses that the change is a setback that limits the PF’s actions against organized crime.

“It’s a setback. This paragraph creates a difficulty, an obstacle, so much so that this action by the Federal Police will depend on provocation from the governor. In the expert’s assessment, the measure goes in the opposite direction of the Security PEC, sent by the federal government, which provides for greater integration between security forces.

“Today there is no need for this prior provocation from the governor, or even the Ministry of Justice. When there is a crime that has interstate or transnational repercussions, the competence for this is automatically transferred to the Federal Police and the Federal Court. And then it will act in coordination with the state police, as has normally happened”, he added.

On the other hand, the president of the Association of Police Delegates of Brazil (Adepol), Civil Police delegate Rodolfo Laterza, assesses that the change proposed by Derrite does not make the work of the PF unfeasible, which would be protected in the text.

“On the contrary, it strengthens the mechanisms of integration and respect for the federative pact, avoiding overlapping investigations that often lead to rework. The device strengthens joint or coordinated action between state and federal forces”, he highlighted.

Repercussion

The leader of the PT in the Chamber, deputy Lindberg Farias (PT-RJ), maintained that the change seeks to impede the actions of the PFwhich, according to him, would make investigations such as Carbono Oculto, which targeted organized crime money laundering, unfeasible.

“Instead of strengthening the fight against organized crime, the rapporteur does the opposite: he takes power away from the PF, protects laundering networks and prevents direct cooperation between police, contrary to what was proposed in the Security PEC”, stated Lindberg on a social network.

The parliamentarian from Rio de Janeiro assesses that the measure violates article 144 of the Constitution, in the section that says that the PF must investigate “infractions whose practice has interstate or international repercussions and requires uniform repression”.

THE Brazil Agency He sought out Deputy Derrite to comment on the topic and is awaiting his position on the matter. On a social network, Derrite highlighted that the PL seeks to confront “impunity”.

Friction

The choice of a secretary of the São Paulo government, in opposition to the federal government, to report the PJ signed by President Luiz Inácio Lula da Silva was interpreted by government officials as a “provocation” by the president of the Chamber, Hugo Motta (Republicanos-PB), who is from the same party as governor Tarcísio de Freitas.
